Strengthening Propaganda, Educational  Activities and Marine Laws Implementation


Marine regulations should be observed as the guiding principle of human activities in the marine field, all activities violating these regulations should be forbidden or even punished in order to defend the dignity of them. This is what we call Law Enforcement.

The most effective measure in implementing marine regulations is precaution. To accomplish this task, we should widely publicize knowledge of marine regulations, argument for the management regulations implementation among coastal population and ocean users. By these means the public marine awareness can be improved and all kinds of marine regulations can be observed. The effects will be obvious.


Strengthening Propaganda and Education and Intensifying Marine Awareness

1. Strengthening Education and Intensifying Awareness

There are also many illiterates on oceanographic general knowledge except for those illiterates on culture and laws, the public ocean awareness is limited. This situation is largely affected by long-term traditional notions such as "The Policy of Marine Activities Forbidding" issued in Ming and Qing Dynasties and bounded by notions of "Continentalism" and "Close-the-door Policy". Further more, the characteristic of high investment and risk for the harsh marine environment are also unneglectable factors for the jurisdiction on the importance of the sea. Because of the insufficient propaganda and education, few people can tell something about the sea, have little awareness of the importance of the sea in the building up of national defense and the national economy. In recent years, Chinese government has attached more attention to the marine cause, but the improvement of public awareness of the sea will be a long-term and arduous task. The illiteracy on marine knowledge has not receive as much attention as that the illiteracy on culture and laws have received.

Our country should pay more attention to education of oceanographic area and strengthen the improvement to public awareness of the sea as a strategy. The education should be started from childhood and add the content of oceanographic knowledge into the textbooks of primary school, middle school and high-learning institutions to help the students to rear notions of the sea. With the development of national economy, more educational institutions should be established, and more investment and attentions should be put onto the marine cause. By all means of broadcast, telecast, movie and publication, marine science should be publicized among the people to eliminate the illiterates on marine science. The change in international law of the sea, status of marine resources development at home and abroad and status and trend of marine economy should be publicized widely to catch up with the pace of marine development world wide.

2. Intensifying the Propaganda and Improving the Awareness of Territory

United Nations Convention on the Law of the Sea was adopted at the third session of The Third Conference of Marine Laws in 1982, which brought a huge innovation on international policies of the marine laws. In the past, the coastal countries only have the ownership of marine resources within their territorial sea, but they have also obtained the sovereignty of broader areas including the areas under their jurisdiction and any other country can't interfere in the sovereignty. According to the UNCLOS, the jurisdictional marine area in China will account for about one third of our total territory. We should put as much emphases on the territorial sea as we have put on the land, improving the awareness of the sea and changing the traditional notion of "The Land being More Important than The Sea".

3. Intensifying the Propaganda and Strengthening the Managerial Awareness

Now the people often pay much attention to the marine development and neglect the scientific management especially the integrated management to the sea. To improve this present situation, we should propagate through different ways the relationship between marine resource development and departmentally separate management, relationship between comprehensive management and department management and the function of comprehensive management in marine development. The awareness of comprehensive management should be strengthened in order to help the people deal with the relationship between present benefit and the long-term benefit, private benefit and state benefit, partial benefit and integrated benefit properly.


Intensifying Marine Law Enforcement and Safeguarding the dignity of Marine Laws and Regulations

Our marine laws and regulations are made according to our country's needs, it reflects the willingness of the nation and the people and is a code of conduct to protect the primary benefit of China and its people. But only having the laws and regulations is not enough, it won't play its potent role unless we execute them strictly. It requires us to establish an effective law enforcement supervising group squad to secure their execution.

1. Equipping with Effective Facilities for the Enforcement

Many foreign governments pay much attention to the equipment of necessary facilities. Generally speaking, our capability of law enforcement on the sea is still very weak, having only 28 vessels and two planes over the broad sea area is far more enough. Many marine management departments have few patrolling vessels, and most of the vessels are outdated and slow in speed and cannot catch up with the outlawed vessels.

2. Training Qualified Personnel for Law Enforcement

On the basis of the clear stipulation of some relative responsibility dividing laws and regulations, China State Oceanic Administration, as the marine administrative department belonging to the State Council, has established a strong marine administrative squad in charge of marine administration.

During the past several years, local governments of coastal provinces, autonomous regions and municipal cities attached much attention to marine administration and established some local marine administrative facilities. These facilities are all the constructional foundations of marine laws and regulations execution. But the administrative personnel are enough and with inefficient training. At the same time, this weak administrative group disperses among several administrative department. As a result, the tasks of strengthening the administrative group, improving the quality and level of marine administrative personnel have been the essential problems.

3. Establishing Modern Law-enforcement Information Defending Systems

Modern marine management and execution, searching and rescue work are heavily depend on advanced Information Defending System, which includes three-dimensional network used for survey and oceanic data collection. The System can supply the sea activities with forecast service system and communication system used for fast investigation and broadcasting of sea trends, as well as the security system equipped with radar and computers as its main technical means.

The main task of our Marine Information System is to collect basic data on marine Science.
